Document Acceptance Policy & Recording Requirements
Requirements

Require all documents to originally signed and notarized/acknowledged with appropriate
names and dates

All names to by typed or printed under signatures on all documents

Correct legal descriptions

Correct fees (see fee schedule)

Sufficient space at top or bottom of first page, or bottom of last page for recording of Register of Deeds Stamps. Otherwise the stamp will be put on back of the document and there will be an additional fee

The document shall be sufficiently legible to produce a clear & legible reproduction

The Register of Deeds may reject any document that is not legible
Deeds
Requires at this time, a three-part Sales Validation Questionnaire form unless meeting the requirements of K.S.A. 79-1437(a) exceptions.
This exception must be typed on deed: "Pursuant to K.S.A. 79-1437(a) a real estate validation questionnaire is not required due to exception No._________."
Also if there is a change of tax address on an exempt deed, i.e., Sheriff's Deed, deeds that have been in escrow more than 5 years, etc., we are requiring that the Sales Validation Questionnaire be partially completed. For exempt deeds, the form does not have to be signed and can be faxed to us.
Mortgage Assignments / Releases
Document should refer to the original mortgage stating names, legals, and Book & Page. Assignments should also have complete address of assignee.
Oil and Gas Assignments / Releases
Document should refer to recording data of original lease.
Notary
According to K.S.A. 42-258 a $1.00 fee will be assessed for failure of notary to type or print their name under signature, unless using an inked stamp with name and imprint of of seal is very legible.
